Working with the Information Regulator
When necessary, the information officer is required to assist the Information Regulator with its investigations of processing subject to prior authorisation and its assessments in respect of the processing of personal information for the purpose of ascertaining whether or not the information is processed according to the conditions for the lawful processing of personal information.
The information officer will be required to provide the Information Regulator with information regarding a responsible party or operator's processing operations, explain the processing activities and the safeguards used to protect the personal information being processed. In some instances the information officer may be required to provide the information requested by the Information Regulator in under 72 hours.
Should an interference with the rights of a data subject occur the information officer will be required to assist the Information Regulator investigate the complaint about alleged violations of the protection of personal information of data subjects and assist the Information Regulator prepare its reports to the complainant in respect of such complaints.
Should it be necessary, the information officer may be required to facilitate the Information Regulator's access to a responsible party or operator's processing operations for the purpose of inspecting the operations, conducting audits and verifying compliance with the conditions for the lawful processing of personal information.
Handle any notices served by the Information Regulator in terms of the Protection of Personal Information Act and the Promotion of Access to Information Act, and respond appropriately to the requirements of such notices within the time periods specified. An information officer who refuses to comply with an enforcement notice served in terms of section 77J of the Promotion of Access to Information Act is guilty of an offence and liable upon conviction to a fine or to imprisonment for a period not exceeding three years or to both such a fine and such imprisonment.
